These Terms and Conditions (“Terms”) govern your use of the website at bellecooper.com.au (“the Site”) and any purchase you make from it. The Site is owned and operated by Sovereign Digital Pty Ltd (ABN 34 660 361 339), trading as Belle & Cooper, of 39 Kirsty Drive, Tanawha QLD 4556 (“Belle & Cooper”, “we”, “us”, “our”).

By placing an order or otherwise using the Site, you agree to be bound by these Terms. If you do not accept them, please do not use the Site.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to place an order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.

2. Products and pricing

  • All prices are shown in Australian Dollars (AUD) and include GST where applicable.
  • We may change prices, product descriptions and availability at any time without notice. Changes do not affect orders we have already accepted.
  • Product images are for illustration. Small variations in colour, finish or packaging may occur.
  • We try to keep stock and lead-time information accurate but do not guarantee continuous availability of any product.

3. Orders and payment

  • An order placed on the Site is an offer to purchase. We accept the offer when we send you an order-confirmation email; until then, no contract is formed.
  • We may decline or cancel any order, including (but not limited to) cases of suspected fraud, incorrect pricing, stock outage, or breach of these Terms. If we cancel, we will refund any payment in full.
  • Payment is taken at the time of order. We accept the payment methods shown at checkout. You authorise us (and our payment processor) to charge the full order total to the payment method you choose.

4. Shipping and delivery

  • Belle & Cooper curates products from global makers. Most orders take 2 to 3 weeks to arrive from the date your order is dispatched. Some products may take longer during peak periods or due to events outside our control.
  • Risk in the goods passes to you on delivery to the address you provide. Title passes once payment has cleared in full.
  • You are responsible for providing an accurate delivery address. We are not liable for delays or non-delivery caused by incorrect, incomplete or out-of-date address information.
  • If a parcel is returned to us as undeliverable, we will contact you to arrange re-delivery. Re-delivery fees may apply.

5. Returns, refunds and Australian Consumer Law

Your statutory rights. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

60-day Double Satisfaction Guarantee. We stand behind our products. Beyond the statutory rights set out above, we offer a satisfaction-based guarantee: if at any time within 60 days of delivery you are not satisfied with your purchase, we will refund you twice the price you paid for the product (capped at $200 per order) – no questions asked, no proof of fault required, used or unused. The only condition is that you send the product back to us. This confirms the return is made in good faith. To start a return, email [email protected] with your order number; we will reply within one business day with the return address. You cover return shipping on satisfaction returns; we do not pay return postage. Once we receive the item, your double-refund is processed within 3 business days. Faulty or incorrect items. If an item arrives faulty, damaged or significantly different from its description, contact us within 7 days of delivery with photos and your order number. We will arrange a replacement, repair or refund in line with the Australian Consumer Law. For faulty returns, we cover return shipping.

6. Accounts

If you create an account, you are responsible for keeping your login details confidential and for any activity under your account. Tell us promptly if you suspect unauthorised access.

7. Intellectual property

All content on the Site (logos, product names, copy, images, layout, code) is the property of Belle & Cooper or its licensors and is protected by Australian and international copyright and trademark law. You may not copy, reproduce, distribute or create derivative works without our prior written permission.

8. Acceptable use

You must not use the Site to: (a) breach any law or regulation; (b) infringe the rights of any third party; (c) transmit malware, spam or any harmful content; (d) attempt to gain unauthorised access to the Site or its underlying systems; or (e) interfere with the Site’s operation.

9. Limitation of liability

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law or other rights we cannot lawfully limit or exclude. Subject to that, our total liability for any claim arising out of or in connection with your purchase or use of the Site is limited, at our option, to the resupply of the goods, the repair of the goods, or the refund of the price paid for them.

10. Privacy

Personal information we collect is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

11. Third-party links

The Site may link to third-party websites or services for your convenience. We are not responsible for the content, accuracy or practices of any third-party site.

12. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page with the “Last updated” date at the top. If you continue using the Site after we post changes, you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. The Queensland courts have non-exclusive jurisdiction over any dispute arising from or in connection with them, without limiting your rights under the Australian Consumer Law.
